This paper is an attempt to explain how we can still represent Grandparents in access cases in light of <a href=\"http:\/\/scholar.google.com\/scholar_case?q=troxel&amp;hl=en&amp;as_sdt=4,44&amp;case=10935528927815644277&amp;scilh=0\"><i>Troxel<\/i><\/a><em><\/em>. If you are representing the parent, <i>Troxel<\/i> is still your sword.<\/p>\n<p>This article is divided by questions you should ask and the facts Grandma gives you.<\/p>\n<h3>II. \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <span style=\"text-decoration: underline;\">Grandma Calls and wants Access<\/span><\/h3>\n<p>Can you help? Answer: Maybe, Let me hear more!<\/p>\n<h4>A.\u00a0\u00a0\u00a0\u00a0 First, and foremost: Determine if Grandma meets the \u201cold\u201d requirements. What I mean by this is whether one of the requirements under subparagraph (3) can be met:<\/h4>\n<ul>\n<li>the Grandparent\u2019s child has been in Jail for at least the past 3 months<\/li>\n<li>the Grandparent\u2019s child has been found incompetent<\/li>\n<li>the Grandparent\u2019s child has died<\/li>\n<li>the Grandparent\u2019s child does not have court ordered access<\/li>\n<\/ul>\n<p>Then you want to make sure that <strong>both<\/strong> parents have not had their rights terminated! See <a href=\"http:\/\/law.onecle.com\/texas\/family\/153.434.00.html\">\u00a7153.434(1)(B)<\/a>. If both parents&#8217; rights have been terminated, your Grandma is probably out of luck.<\/p>\n<p>However, if both parents have had their rights terminated by <strong>CPS<\/strong> and Grandma has NOT been given access then you need to look at <a href=\"http:\/\/law.onecle.com\/texas\/family\/102.003.00.html\">\u00a7102.003(a)(12)<\/a> and <a href=\"http:\/\/law.onecle.com\/texas\/family\/102.004.00.html\">\u00a7102.004<\/a>! In a CPS case only, you have 90 days after the termination to still try and get Grandma in the door.<\/p>\n<h4>B.\u00a0\u00a0\u00a0\u00a0 Second, ask Grandma questions about whether the parent is a fit parent or not. And ask Grandma questions to see if she would have standing under \u00a7102.003.<\/h4>\n<p style=\"text-align: center;\" align=\"center\">\u00a0<strong>Sounds like a \u201cFit\u201d parent and you don\u2019t have any facts that could give you Standing under \u00a7102.003:<\/strong><\/p>\n<p>Result:\u00a0\u00a0\u00a0\u00a0 Grandma still falls under <a href=\"http:\/\/law.onecle.com\/texas\/family\/153.433.00.html\">\u00a7153.433<\/a> and she has to overcome the biggest hurdle.<\/p>\n<p>Burden:\u00a0\u00a0 Can you prove by a preponderance of the evidence that denial of possession of or access to the child (by Grandma) would significantly impair the child\u2019s physical health or emotional well being?<\/p>\n<p>Law:\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 You better have an expert! In July of 2008 the Ft. Worth court of appeals stated, \u201cThe mere opinion of the grandparents themselves and an interested, nonexpert witness that the grandparents should be granted access does not overcome the statutory presumption.\u201d <a href=\"http:\/\/scholar.google.com\/scholar_case?q=In+the+Interest+of+J.P.C.&amp;hl=en&amp;as_sdt=4,44&amp;case=13126222319761754406&amp;scilh=0\"><em>In re J.P.C.<\/em><\/a>, 261 S.W.3d 334, 340 (Tex. App.\u2014Fort Worth 2008, no pet.).<\/p>\n<p>Facts:\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 The grandchild probably hasn\u2019t seen an expert before Grandma calls. If Grandma has had close, loving, and\/or a significant relationship with her grandkids, then I say file the access suit!<\/p>\n<p>My Spin:\u00a0 Petition the court for temporary orders and ask the Court to appoint an expert to address the issue, but DON\u2019T ask for \u201cTemporary Access.\u201d Also, you may want to ask the Court to confer with the child.<\/p>\n<p>None of the cases that I have included have addressed the issue whether the appointment of an expert in a Grandparent access case offends the rationale in <i>Troxel<\/i>. You could rely on <i>Derzapf<\/i> where the trial court appointed an expert during temporary orders to advise the court whether the grandparents should have access. <a href=\"http:\/\/scholar.google.com\/scholar_case?q=In+re+Derzapf&amp;hl=en&amp;as_sdt=4,44&amp;case=3191397869337681361&amp;scilh=0\"><em>In re Derzapf<\/em><\/a>, 219 S.W.3d 327, 328 (Tex. 2007). However, in <em>Derzapf<\/em> the Supreme Court of Texas held that only biological or adoptive grandparents, not step-grandparents, had standing to seek access.<\/p>\n<p>Note: \u00a0 \u00a0\u00a0\u00a0\u00a0\u00a0 If you represent the parents you should argue that appointing an expert and subjecting your client and the kids to counseling offends <i>Troxel<\/i>.<\/p>\n<h4>C.\u00a0\u00a0\u00a0\u00a0 Now assume these are the facts:<\/h4>\n<p align=\"center\">\u00a0<strong>Parent is a fit parent, but Grandma HAS standing under \u00a7102.003.<\/strong><\/p>\n<p align=\"center\"><strong>PLEAD FOR JMC &amp; ACCESS<\/strong><\/p>\n<p>Now you need to find out if there is a prior court order. If so, file a modification and argue that the parental presumption and <i>Troxel<\/i> does not apply! See <a href=\"http:\/\/scholar.google.com\/scholar_case?q=In+the+Interest+of+M.P.B&amp;hl=en&amp;as_sdt=4,44&amp;case=547760633938580426&amp;scilh=0\"><i>In the Interest of M.P.B<\/i><em>.<\/em><\/a>, 257 S.W.3d 804 (Tex. App.\u2014Dallas 2008, no pet.);\u00a0<a href=\"http:\/\/scholar.google.com\/scholar_case?q=In+Re+C.A.M.M.&amp;hl=en&amp;as_sdt=4,44&amp;case=4790786650103954883&amp;scilh=0\"><i>In Re C.A.M.M<\/i><em>.<\/em><\/a>, 243 S.W.3d 211 (Tex. App.\u2014Houston [14th Dist.] 2007, pet. denied). If you are representing the parent, however, rely on <a href=\"http:\/\/scholar.google.com\/scholar_case?q=In+Re+Kelso&amp;hl=en&amp;as_sdt=4,44&amp;case=12068318954060043031&amp;scilh=0#r[1]\"><em>In re Kelso<\/em><\/a>, 266 S.W.3d 586 (Tex. App.\u2014Fort Worth 2008, no pet.).<\/p>\n<p>If Grandma has standing under \u00a7102.003 she can file an original suit or a modification. If you are filing an original suit, then the parental presumption applies but you could still argue that Grandma has standing to be named a joint managing conservator. If Grandma has a \u201clegitimate\u201d threat of being named a JMC, then Grandma has more leverage to negotiate an access settlement.<\/p>\n<p>Grandma would most likely have standing if the grandchild lived in her house for at least six months ending not more than 90 days preceding your filing. The six months doesn\u2019t have to be continuous and uninterrupted. It just has to be the child\u2019s principal residence.<\/p>\n<h4>D.\u00a0\u00a0\u00a0\u00a0 Now assume the Parent is Unfit:<\/h4>\n<p style=\"text-align: center;\" align=\"center\">\u00a0<strong>The child\u2019s present circumstances would significantly impair the child\u2019s physical health or emotional development<\/strong><\/p>\n<p style=\"text-align: left;\">Your Grandma has standing under \u00a7102.004 to ask for custody, and in the alternative Grandma can plead for access. Again, this may lead the parties to negotiate a settlement regarding access.<\/p>\n<h3>III.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <span style=\"text-decoration: underline;\">Ancillary Issues<\/span><\/h3>\n<h4>A.\u00a0\u00a0\u00a0\u00a0 I was Home Towned!<\/h4>\n<p>I won\u2019t name names, but I was in a county other than Lubbock, and I was representing the mother in a Grandparent access case.<\/p>\n<p>At the first hearing I <strong>successfully<\/strong> argued that Grandma didn\u2019t have standing under the statue. Then the father, who was in a court ordered rehab facility, filed an enforcement against my client (with the same attorney). He couldn\u2019t leave the facility and couldn\u2019t visit his child at the facility.<\/p>\n<p>I thought no problem, right? <strong>Wrong<\/strong>. The judge ordered that the father could designate anyone he wanted to exercise his periods of possession, i.e. Grandma. I wasn\u2019t prepared for this kind of judicial discretion.<\/p>\n<p>If this happens to you, I think you should rely on <a href=\"http:\/\/scholar.google.com\/scholar_case?q=In+the+Matter+of+Marriage+of+Campbell&amp;hl=en&amp;as_sdt=4,44&amp;case=16711943410749740338&amp;scilh=0\"><em>In re Marriage of Campbell<\/em><\/a>, 06-08-00088-CV, 2009 WL 483602 (Tex. App.\u2014Texarkana Feb. 27, 2009, no pet.).<\/p>\n<h4>B.\u00a0\u00a0\u00a0\u00a0 Can You Get out of a Pre-Troxel Grandparent Access Order?<\/h4>\n<p>Maybe \u2013 See <i>In re C.P.J.<\/i> The Texarkana court of appeals seems to say you may be able to get out of the agreement in light of <i>Troxel<\/i>.<\/p>\n<p>No \u2013 See <a href=\"http:\/\/scholar.google.com\/scholar_case?q=In+re+C.P.J.+&amp;hl=en&amp;as_sdt=4,44&amp;case=12089160821520223388&amp;scilh=0\"><i>In re C.P.J.<\/i><\/a>, 129 S.W.3d 573 (Tex. App.\u2014Dallas 2003, pet. denied). The Dallas court of appeals says you can\u2019t get out of it even after <i>Troxel<\/i>.<\/p>\n<p>No \u2013 See <a href=\"http:\/\/scholar.google.com\/scholar_case?q=Spencer+v.+Vaughn&amp;hl=en&amp;as_sdt=4,44&amp;case=12054863698918103207&amp;scilh=0\"><i>Spencer v. Vaughn<\/i><\/a>, 03-05-00077-CV, 2008 WL 615443 (Tex. App.\u2014Austin Mar. 6, 2008, pet. denied). The Austin court of appeals affirmed jury decision to modify grandparent access.<\/p>\n<h4>C.\u00a0\u00a0\u00a0\u00a0 Specific Days &amp; Times<\/h4>\n<p>Lastly, an Amarillo case says if Grandma does get access, then the trial court should give Grandma specific times and days in which to exercise her access. See\u00a0<a href=\"http:\/\/scholar.google.com\/scholar_case?q=+In+the+Interest+of+Justin+Webster&amp;hl=en&amp;as_sdt=4,44&amp;case=3471146395093202339&amp;scilh=0\"><em>In re Webster<\/em><\/a>, 982 S.W.2d 526 (Tex. App.\u2014Amarillo 1998, no pet.). <strong>Note<\/strong>: This opinion was issued before <i>Troxel<\/i>.<\/p>\n<h4>D.\u00a0\u00a0\u00a0\u00a0 Step Parent Adoption doesn\u2019t keep Grandma out<\/h4>\n<p>See <a href=\"http:\/\/scholar.google.com\/scholar_case?q=Raines+v.+Sugg&amp;hl=en&amp;as_sdt=4,44&amp;case=4352606395301582706&amp;scilh=0\"><i>Raines v.
